Terms of Service

1. Agreement to Terms

By accessing or using the Scaling Sites website at tryscalingsites.com (“Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Scaling Sites provides custom landing page design, full website design, and related digital marketing services for businesses. We also offer optional hosting and CRM integration services for an additional fee.

3. Waitlist & Communications

By joining our waitlist, you consent to receive communications from Scaling Sites regarding service availability, updates, and related information. You may unsubscribe at any time by contacting us directly.

4. Project Scope & Delivery

Each project begins with a discovery call to define scope, deliverables, and timeline. Our standard turnaround is 7 business days from the completion of the discovery call. Final deliverables, timelines, and pricing are confirmed in a separate project agreement before work begins.

5. Payment Terms

Payment terms, pricing, and schedules are established in individual project agreements. All fees are non-refundable once work has commenced unless otherwise stated in the project agreement.

6. Intellectual Property

Upon full payment, clients receive ownership of all custom code, designs, and copy created for their project. Scaling Sites retains the right to display completed work in portfolios and case studies unless otherwise agreed in writing.

The Scaling Sites name, logo, and website content remain the property of Scaling Sites and may not be reproduced without written permission.

7. Client Responsibilities

Clients are responsible for providing accurate business information, brand assets, and timely feedback during the project. Delays in client responses may extend the delivery timeline beyond the standard 7-day turnaround.

8. Limitation of Liability

Scaling Sites provides landing pages and websites designed to support your marketing efforts. We do not guarantee specific conversion rates, revenue outcomes, or advertising performance. Our Service is provided “as is” without warranties of any kind, express or implied.

To the maximum extent permitted by law, Scaling Sites shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service or any deliverables provided.

9. Hosting Services

If you purchase optional hosting through Scaling Sites, we will maintain uptime on a commercially reasonable basis. We are not liable for downtime caused by third-party hosting providers, DNS propagation, or circumstances beyond our control. Hosting may be canceled by either party with 30 days written notice.

10. Termination

Either party may terminate a project agreement with written notice. If Scaling Sites terminates, we will deliver all completed work to date. If the client terminates after work has begun, fees for completed work are non-refundable.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles.

12. Changes to Terms

We reserve the right to update these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the Service after changes constitutes acceptance of the revised terms.
